Terms of Service

1. Introduction

Welcome to Thoth, an application developed and operated by Temple Enigmatic. Thoth is a specialized service designed for the Tabletop Role-Playing Game (TTRPG) community. It transcribes user-uploaded audio recordings of game sessions and, using AI, generates organized summaries and related notes ("Generated Content"). These Terms of Service ("ToS") govern your access to and use of the Thoth app and all related services (the "Service"). By creating an account or using our Service, you agree to be bound by these ToS.

2. Accounts and Access

To access the full features of the Service, you must create an account. You agree to provide accurate and complete information and to keep this information up to date. Access may require a valid invitation code, as the Service is currently in a controlled release. You are responsible for safeguarding your password and for all activities that occur under your account.

3. User Content and Data

3.1. Your Content. You are solely responsible for all audio recordings, campaign details (including character and location names), and any other information you upload, submit, or create within the Thoth app ("User Content"). You represent and warrant that you have all necessary rights, licenses, and consents to use your User Content with our Service. You retain all ownership rights to your User Content and the resulting Generated Content.

3.2. License to Temple Enigmatic. By uploading User Content, you grant Temple Enigmatic a worldwide, non-exclusive, royalty-free, and transferable license to use, reproduce, process, and store the User Content solely for the purpose of operating and providing the Service to you. This includes the right to process your audio files and campaign data to create the Generated Content. This license terminates when you delete the corresponding User Content or your account.

3.3. Data Handling and Privacy. We are committed to protecting the privacy of your stories. Our data handling practices are as follows:

• Audio Files: The original audio recording you upload is automatically and permanently deleted from our servers after it has been successfully processed by our AI partner (n8n).
• Generated Content: The text-based summaries and notes created from your audio are stored in your account for your use. You have full control to view and delete this Generated Content at any time.
• No AI Training: We will not use your User Content or Generated Content to train or improve our own or any third-party AI models without your explicit, opt-in consent.

4. User Responsibilities

4.1. Consent for Recording. You are solely responsible for complying with all applicable laws regarding audio recording. This includes obtaining explicit consent from all individuals participating in a session before you record and upload the audio to the Service. You agree to indemnify Temple Enigmatic against any claims arising from your failure to obtain proper consent.

4.2. Prohibited Content. You agree not to upload any User Content that is unlawful, defamatory, infringing on intellectual property or privacy rights, or contains malicious code. We reserve the right to remove any content and terminate accounts that violate these terms.

5. The Service

5.1. Intellectual Property. The Thoth app, its name, logo, branding, and all related software are the exclusive property of Temple Enigmatic. You may not use our intellectual property without our express written permission.

5.2. Offerings (Donations). The core functionality of Thoth is provided free of charge. We are supported by voluntary donations ("Offerings") from our users. These Offerings are not required for use of the service and are non-refundable. They directly support server costs, maintenance, and future development.

5.3. Thoth's Favor. The "Thoth's Favor" score is a metric provided for entertainment purposes to reflect your usage of the Service's processing resources. It holds no monetary value and confers no special rights or privileges.

6. Disclaimers and Liability

6.1. "As Is" Service. The Service is provided "as is" and "as available." We do not warrant that the Service will be uninterrupted, error-free, or that the Generated Content will be perfectly accurate. AI-powered analysis can be subject to errors and misinterpretations.

6.2. Limitation of Liability. To the fullest extent permitted by law, Temple Enigmatic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, resulting from your use of the Service.

7. Termination

We may suspend or terminate your account at our discretion, without notice, if you breach these ToS. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease, and we may delete all User Content and Generated Content associated with your account.

8. Governing Law

These ToS shall be governed by the laws of [Your State/Country], without regard to its conflict of law principles. Any disputes will be resolved in the courts of [Your City, Your State/Country].

9. Changes to These Terms

We reserve the right to modify these ToS at any time. We will provide notice of material changes by notifying you through the Service or by email. Your continued use of the Service after changes become effective constitutes your acceptance of the new ToS.
